EU declaration of conformity: what you need.

Since 12.08.2026, manufacturers of packaging must declare conformity and keep documentation. This page explains what the declaration is, who needs it, what it must contain and what you check as a distributor or importer.

What is the EU declaration of conformity?

The EU declaration of conformity is a document in which the manufacturer declares that its packaging meets the requirements of the PPWR. By doing so, the manufacturer takes responsibility for compliance.

It is supplemented by the technical documentation. This shows how the requirements are met.

Who needs it?

  • Manufacturers: They issue the declaration and keep the technical documentation.
  • Importers: They check that the manufacturer has issued the declaration and that the documents are available.
  • Distributors and online shops: Before reselling, they check that the evidence is available.
  • Fillers and brands: They request the declaration from their suppliers.

What belongs in the declaration?

The exact content is set out in the Regulation. A declaration usually contains:

  • name and address of the manufacturer
  • a unique identification of the packaging (product, type, item number or batch)
  • the statement that the manufacturer is solely responsible
  • a reference to the requirements met and the standards or specifications applied
  • place, date and signature

Technical documentation

It describes the packaging and proves compliance with the requirements. This typically includes:

  • material composition and structure of the packaging
  • evidence on heavy metals and, for food contact, on PFAS
  • information on recyclability, once the requirements apply
  • test reports from suppliers

Manufacturers keep the documents and make them available to authorities.

What is the difference between the EU declaration of conformity and the technical documentation?

The EU declaration of conformity is the manufacturer's statement that the packaging meets the requirements. The technical documentation consists of the documents that prove this, for example material information and test reports.

Do I have to issue an EU declaration of conformity myself as a distributor?

In principle, the manufacturer issues it. As a distributor, you check that the evidence is available. Anyone who places packaging on the market under their own name or brand may be considered a manufacturer. If in doubt, have this checked.

Does the obligation also apply to packaging from third countries?

Yes. The PPWR applies to packaging placed on the market in the EU. Importers check that the manufacturer has issued the declaration.

How long do I have to keep documents?

The Regulation sets the period. File the documents in an orderly way by item and ask for legal advice if you are unsure.
