Frequently asked questions

Who issues the declaration of conformity?

The manufacturer of the packaging (Art. 15, 39). Importers keep a copy available (Art. 18). Anyone who places packaging on the market under their own name or brand counts as the manufacturer and issues it themselves (Art. 21).

Is the template legally binding?

No. The template follows the structure of Annex VIII and does not replace legal advice. The text of Regulation (EU) 2025/40 is what is binding. The declaration must be available in the language or languages that the Member State requires (Art. 39(2)).

Does a declaration have to be available for every item?

The declaration is issued for each type of packaging and must make clear which packaging it applies to (Annex VII, Module A, point 4). Filing by item helps you assign the declaration and the packaging clearly.

How long do I have to keep the documents?

The manufacturer keeps the declaration and the technical documentation available for five years for single-use packaging and ten years for reusable packaging, counted from placing on the market (Art. 15(3)). Importers keep the copy of the declaration available for the same periods (Art. 18(7)).
